Terms of Service

Acceptance of Terms

By accessing or using the FinishStrong application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and FinishStrong ("we," "us," or "our").

Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you are at least 13 years old. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Account Registration

To access certain features of the Service, you may create an account using our third-party authentication provider, Supabase Auth. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

User Conduct

You agree not to:

• Cheat, manipulate, or exploit bugs in the Service to artificially inflate scores, streaks, or leaderboard rankings.
• Scrape, crawl, or use automated tools to extract content, questions, or data from the Service.
• Harass, bully, threaten, or intimidate other users through any social features of the Service.
• Impersonate another person, user, or entity, or falsely represent your affiliation with any person or organization.
• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse-engineer, decompile, or disassemble any portion of the Service.
• Interfere with or disrupt the Service's infrastructure, servers, or networks.

Content Ownership

• FinishStrong content: All questions, explanations, educational materials, algorithms, and other content provided through the Service are owned by FinishStrong or its licensors and are protected by copyright and other intellectual property laws.
• Your data: You retain ownership of your personal data, including your scores, responses, progress history, and account information.
• User-generated content: Any content you create through the Service (such as reflections or squad messages) remains yours, but you grant FinishStrong a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content solely for the purpose of operating and improving the Service.

SAT^® is a registered trademark of the College Board. FinishStrong is not affiliated with, endorsed by, or sponsored by the College Board. All references to the SAT are for informational purposes only.

All FinishStrong branding, logos, trademarks, source code, algorithms, and educational content are proprietary and may not be copied, reproduced, distributed, or used without prior written permission.

Disclaimers

• FinishStrong does not guarantee any specific SAT score improvements. Results vary based on individual effort, starting level, and other factors.
• Predicted SAT scores displayed within the Service are statistical estimates based on your mastery data and equating curves from real test administrations. They are not guarantees of actual performance.
• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by applicable law, FinishStrong and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising out of or related to your use of the Service. In no event shall our total liability to you exceed the amount you have paid to FinishStrong (if any) in the twelve (12) months preceding the event giving rise to the claim.

Termination

Either party may terminate these Terms at any time. You may stop using the Service and request deletion of your account at any time. We reserve the right to suspend or terminate your access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon request, your personal data will be deleted in accordance with our Privacy Policy.

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service with a revised "Last Updated" date or by sending an email notification. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Delaware, and the decision of the arbitrator shall be final and binding.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
